1. Who we are

This website at jackpati.com (the "Site") is operated by JP DESIGN ("we", "us", "our"), a business based in Calgary, Alberta, Canada. By visiting the Site or placing an order you agree to these Terms of Service, together with our Privacy Policy, Refund & Return Policy and Shipping Policy, which are incorporated here by reference.

If you do not agree with these terms, please do not use the Site.

2. Eligibility

You must be at least the age of majority in your province or territory of residence to place an order, or have the consent of a parent or guardian. By placing an order you confirm that you meet this requirement and that the information you give us is accurate and complete.

3. Products

All items are printed to order. We make every effort to display colours and designs accurately, but we cannot guarantee that your screen shows colours exactly as they appear on the finished garment. Slight variation in print placement — typically up to 1 inch — is normal in direct-to-garment printing and is not considered a defect.

Product availability, descriptions and prices may change at any time without notice. We may limit the quantity of any item sold, and we may discontinue any product at any time.

4. Prices and payment

All prices are listed in Canadian dollars (CAD) and exclude applicable taxes, which are calculated at checkout. We reserve the right to correct pricing errors, including after an order has been submitted — if we do so, we will contact you and give you the option to confirm the corrected order or cancel it for a full refund.

Payment is taken at checkout. By submitting payment information you confirm that you are authorised to use the payment method provided.

5. Orders

Your order is an offer to buy. We may accept or decline any order, and we may cancel an order after acceptance where we suspect fraud, an unauthorised transaction, a pricing error, or where the product is unavailable. If we cancel an order that you have already paid for, we will refund you in full.

6. Intellectual property

All designs, artwork, graphics, product photography, text and other content on this Site are owned by us or used under licence, and are protected by Canadian and international copyright and trademark law. You may not reproduce, copy, resell, or create derivative works from our designs — including by printing them on your own merchandise — without our prior written permission.

You may share product photographs on social media for personal, non-commercial purposes with credit to the Site.

7. Your use of the Site

You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorised access to any part of it, to interfere with its operation, to scrape or harvest data from it, or to transmit any malicious code. We may terminate your access to the Site for breach of these terms.

8. User submissions

If you send us reviews, photographs, comments or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business, including for marketing. You confirm that you own the content and that it does not infringe anyone else's rights. We are under no obligation to publish or keep any submission, and we may remove content at any time.

9. Third-party services

This Site is hosted by Shopify, and orders are produced and shipped by third-party production partners. Payment processing, analytics and email delivery are also handled by third parties. Their handling of your information is described in our Privacy Policy. We are not responsible for the content or practices of third-party websites linked from this Site.

10. Disclaimer of warranties

Except as expressly stated in these terms and as required by applicable law, the Site and the products are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, secure or error-free.

11. Limitation of liability

To the fullest extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these terms, the Site, or any product, will not exceed the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable Canadian consumer protection law, including the Consumer Protection Act (Alberta).

12. Indemnity

You agree to indemnify and hold harmless JP DESIGN and its officers, employees and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms of Service or your violation of any law or the rights of a third party.

13. Governing law

These Terms of Service are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in it, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in Calgary, Alberta for any dispute, except where applicable consumer protection law entitles you to bring proceedings in your own province or territory.

14. Changes to these terms

We may update these Terms of Service at any time by posting a revised version on this page and updating the "Last updated" date. The terms in force at the time you place an order are the ones that apply to that order.

15. Severability and entire agreement

If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. These terms, together with the policies referenced above, form the entire agreement between you and us regarding your use of the Site.
